1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of the Tandem application and related services (collectively, the “Service”) provided by LKTech, LLC(“Tandem,” “we,” “our,” or “us”).

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Service description

Tandem is a shared household management platform. It allows household members to collaboratively manage grocery lists, meal plans, bill tracking, reminders, budgets, asset tracking, and a shared calendar. The Service is available as a web application and as native mobile apps for iOS and Android. Changes made by one household member are synced to other members in real time.

3. Eligibility

You must be at least 13 years old to use Tandem (or 16 years old if you are located in a jurisdiction that requires a higher minimum age for digital services, such as certain EU member states). By using the Service, you represent that you meet the applicable age requirement.

Each account must represent one individual person. You may not create an account on behalf of another person without their authorization. You are responsible for providing accurate registration information and keeping it up to date.

4. Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@our-tandem.com if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account where you have failed to keep your credentials secure.

5. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Upload, store, or transmit illegal, harmful, or offensive content
  • Access or probe the Service through automated means (bots, scrapers, crawlers) without our express written permission
  • Attempt to gain unauthorized access to any part of the Service, its servers, or its infrastructure
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to send spam or unsolicited communications
  • Impersonate any person or misrepresent your affiliation with any entity
  • Reverse-engineer, decompile, or disassemble any portion of the Service beyond what is permitted by applicable law

We reserve the right to investigate suspected violations and, where appropriate, suspend or terminate accounts or take legal action.

6. Your content

You retain ownership of all content you create within the Service, including household data, grocery lists, meal plans, bills, and any other content you input (“User Content”). You grant us a limited, non-exclusive, royalty-free license to store, process, display, and transmit your User Content solely as necessary to operate and provide the Service. We do not claim ownership of your data and do not use it for any purpose beyond operating the Service.

You represent that you have all necessary rights to any content you submit to the Service and that your User Content does not violate the rights of any third party.

7. Household memberships

The Service supports household-based collaboration. The person who creates a household is designated as its owner. Household members may be assigned different roles with different permissions. By joining a household, you acknowledge that other household members can view, edit, or delete shared content within that household. You are responsible for who you invite to your household.

8. Pricing and free service

Tandem is currently provided free of charge. We reserve the right to introduce paid plans, usage limits, or premium features in the future. If we do, we will provide reasonable advance notice and you will not be charged without your consent. Free use of the Service may continue to be available in some form at our discretion.

9. Termination

You may stop using the Service and delete your account at any time.

We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, if your account poses a security risk, or if we are required to do so by law. Upon termination, your right to access the Service ceases. We may delete your account data in accordance with our Privacy Policy.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for any loss of data due to technical failures, and you should maintain your own backups of any important information.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TANDEM AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tandem and its affiliates, officers, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved in the courts of the State of Indiana, and you consent to the personal jurisdiction of those courts.

14. Changes to these terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If changes are material, we will provide notice by email or within the Service. Your continued use of Tandem after changes become effective constitutes your acceptance of the revised Terms.
